Terms and Conditions

These Terms and Conditions govern the media services provided by Verity Real Estate Media ("we", "us", "our", "vrem") to the client ("you", "your"). By booking our services, you agree to these terms.
1. Property Readiness & Media Capture
Camera Ready: We want the property to look its absolute best and help you achieve optimum results for the campaign. While we are always happy to assist with on-site guidance or the finalisation of staging to ensure the property is presented perfectly for capture, we do ask that it is well prepared prior to our arrival window. This ensures we can focus on crafting the best imagery for the campaign. In the event a property is not ready, we reserve the right to photograph it "as is." We use our experience and professional judgment to select the best angles, but we warmly welcome your input, if you wish, prior to the shoot.
Privacy & Sensitive Items: We kindly rely on our clients, vendors, and tenants to remove, hide from view, or make us aware of anything they do not want captured in our media. If there is anything specific you need us to avoid, or if you request items to be digitally removed from the final images, please inform us prior to the appointment.
2. Orders, Scope & Additional Fees
Accuracy of Information: You are expected to provide accurate property details at the time of booking. If the scope of work required differs from the provided details, we reserve the right to adjust the pricing to accurately reflect the work involved. We are always happy to provide a quote on non-standard work.
Travel Fees: If a booking is made which would incur a travel fee, we will notify you as soon as possible after the booking is received.
Revisits & Recaptures: We reserve the right to charge revisit fees for any return trips to the property. This is inclusive of client requests to be captured differently, if we were not made aware of these specific requests prior to the original appointment.
3. Scheduling & Cancellations
Changes: We require 24 hours notice for cancellations or rescheduling. Changes made within 24 hours of the appointment may incur a cancellation fee.
Weather & Safety: Appointments that cannot be completed safely or effectively due to weather or other factors beyond our control will be rescheduled. This includes drone operations if conditions are not safe or legal to fly. We aim to keep you informed of any rescheduling needed.
4. Media Delivery & Retention
File Retention: Once final media assets have been delivered, we make no guarantees regarding the permanent retention, hosting, or archiving of those files. While we endeavour to keep backup copies of our work, we cannot guarantee the availability of files for subsequent redelivery. The client maintains responsibility for downloading and securely storing the media upon receipt.
5. Digital Editing & Authenticity
Editing Fees: Any specific client requests for advanced digital editing or retouching (such as virtual staging, object removal, or significant alterations) may incur additional fees.
Accurate Representation: While we strive to maintain the authenticity of the property during the editing process, the client bears full responsibility for ensuring that the final digitally edited output remains a fair, accurate, and legally compliant representation of the space.
6. Licensing & Copyright
Ownership: We retain the copyright and ownership of all media created.
Portfolio Rights: We reserve the right to use any captured media for our own business purposes, including our professional portfolio, website samples, social media marketing, and self-promotion.
Usage Rights: We grant a non-exclusive, non-transferable license to use the media strictly to the nominated party listed on the invoice. This license covers the marketing of the specific property across all relevant print media and online digital platforms (including national, regional and international real estate listing portals), as well as the promotion of the nominated party's real estate business.
Third-Party & Additional Licensing: The license is granted only to the invoiced party. Any requests for relicensing, or the use of our media for purposes other than what was originally licensed, must be submitted to us in writing. If a third party, inclusive of the property owner or a different agent / agency, wishes to obtain a copy of the media for their own use, they must contact us directly to request and purchase a separate license. You may not sell, transfer, or give the media to any third party without our consent.
7. Payment Terms & Overdue Accounts
Invoicing: Payment is required prior to the delivery of final media assets. Media will not be released until the invoice is paid in full.
Account Clients: Exceptions to the pre-payment policy are solely at our discretion. For regular, approved clients on monthly statement billing, invoices are due upon receipt.
Overdue Accounts: Failure to pay monthly statements promptly may result in a pause on new orders. Furthermore, in the event of an overdue account, and upon notification from Verity Real Estate Media, you must immediately cease using the provided marketing materials and remove them from all online platforms and publications until the outstanding balance has been settled in full.
8. Property Access, Safety & Liability
Data Collection: To perform our services, we collect necessary property details, access instructions, and contact information as outlined in our Privacy Policy.
Authorisation & Safety: By booking our services, you warrant that authorised parties have provided explicit consent for Verity Real Estate Media to enter and photograph the property. You also confirm that the premises are safe for our team to operate in. If there are any unsafe, hazardous, restricted, or unauthorised areas that we do not have permission to enter, you must inform us of these areas prior to the shoot.
Indemnification: You agree to indemnify and hold Verity Real Estate Media, its team, and contractors harmless against any claims, liability, injuries, damages, or loss (including legal costs) arising from our performance of these services on the property, from your use of the final media, or from a failure to obtain appropriate clearances and provide a safe working environment.
